Terms of Use

These Terms of Use govern your access to and use of the SearchTalents.co website, mobile applications (iOS and Android), and all associated portals including Job Seeker, Employer, Recruiter, and Contributor platforms (collectively, the "Platform"). By accessing or using our Platform, you agree to these Terms and our Privacy Policy. If you do not agree, please do not use SearchTalents.

1. Platform Purpose

SearchTalents.co is an online employment platform that connects job seekers with employers and recruiters across Australia. We provide tools to post, browse, and apply for job opportunities, manage recruitment pipelines, and access career insights.

SearchTalents acts as a technology intermediary only. We are not a recruitment agency and are not responsible for the actual recruitment, hiring, interview, or job offer process. Any employment relationship formed through the Platform is solely between the job seeker and the employer.

2. Eligibility

By using SearchTalents, you confirm that:

• You are at least 18 years of age
• You have the legal capacity to enter into a binding agreement
• You are using the Platform in compliance with all applicable Australian laws and regulations

If you are accessing the Platform on behalf of a business or organisation, you confirm you have the authority to bind that entity to these Terms.

3. User Responsibilities

When using SearchTalents, all users agree to:

• Provide true, accurate, complete, and current information at all times
• Not post or share any false, misleading, illegal, defamatory, or harmful content
• Use the Platform only for its intended purpose of job searching, hiring, or contributing
• Not attempt to interfere with, disrupt, or compromise the security or operation of the Platform
• Not use automated systems, bots, scrapers, or data mining tools without prior written permission from SearchTalents
• Not impersonate any person, company, or entity
• Not engage in any activity that violates the rights of other users or third parties
• Maintain the confidentiality and security of your account login credentials
• Notify us immediately at hello@searchtalents.co if you suspect unauthorised access to your account

4. Employer and Recruiter Responsibilities

• Employers and Recruiters using the Platform additionally agree to:
• Post only genuine, lawful, and accurate job listings
• Comply with all applicable Australian employment laws, including the Fair Work Act 2009, anti-discrimination legislation, and visa and work authorisation requirements
• Not use candidate data obtained through the Platform for any purpose other than direct recruitment
• Not contact candidates for purposes unrelated to the advertised role
• Ensure job listings do not contain discriminatory, misleading, or unlawful content
• Obtain account approval before posting jobs, as required by SearchTalents verification processes

5. Content Submission

By submitting content to SearchTalents (including job listings, resumes, profile details, articles, or other materials), you:

• Confirm you have the legal right to share that content
• Grant SearchTalents a non-exclusive, royalty-free, worldwide licence to use, display, store, and share that content solely to provide and promote our services
• Acknowledge that your content may be reviewed, moderated, or removed if it violates these Terms or applicable laws
• Retain ownership of your own content, subject to the licence granted above

SearchTalents reserves the right to remove any content that is deemed inappropriate, inaccurate, or in breach of these Terms at our sole discretion.

6. Intellectual Property

All trademarks, logos, text, graphics, software, and other content on the SearchTalents Platform are the property of SearchTalents (operated by IPS) or its licensors and are protected by applicable intellectual property laws.

You may not copy, reproduce, distribute, modify, or use any SearchTalents materials without prior written permission, except as permitted by applicable law.

7. Prohibited Conduct

• You must not use the SearchTalents Platform to:
• Post fraudulent, fake, or scam job listings
• Collect, harvest, or store other users' personal information without consent
• Send unsolicited communications or spam to other users
• Engage in any activity that is unlawful, fraudulent, or harmful to others
• Upload viruses, malware, or any other harmful code
• Circumvent, disable, or interfere with security features of the Platform
• Resell, sublicense, or commercially exploit any part of the Platform without authorisation

8. Service Availability

We aim to keep the SearchTalents Platform running smoothly and reliably. However, we do not guarantee continuous, uninterrupted, or error-free service. We may change, suspend, update, or discontinue parts of the Platform at any time without notice. We will endeavour to provide reasonable advance notice of significant planned outages where possible.

9. Limitation of Liability

To the maximum extent permitted by Australian law, SearchTalents is not liable for:

• Loss of job opportunities, employment offers, or hiring outcomes
• Errors, inaccuracies, or omissions in job posts, user profiles, or Platform content
• Technical issues, downtime, or unauthorised access to your account
• Any indirect, incidental, special, or consequential damages arising from use of the Platform
• Decisions made by employers or recruiters in connection with job applications

Use of the Platform is at your own risk. Nothing in these Terms limits any rights you may have under the Australian Consumer Law.

10. Third-Party Links and Services

The Platform may contain links to third-party websites, employer career pages, and partner services. SearchTalents is not responsible for the content, accuracy, privacy practices, or security of any third-party sites. Accessing third-party links is at your own risk.

11. Account Suspension and Termination

SearchTalents reserves the right to suspend, restrict, or permanently terminate your account or access to the Platform at any time if you:

• Violate any of these Terms of Use
• Provide false or misleading information
• Engage in prohibited conduct or misuse the Platform
• Fail to comply with applicable laws or regulations

We will endeavour to notify you of any account suspension or termination where reasonably practicable. You may also close your account at any time by contacting us at hello@searchtalents.co.

12. Governing Law

These Terms of Use are governed by and construed in accordance with the laws of the State of Victoria, Australia. Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Victoria, Australia.

13. Changes to These Terms

We may update these Terms of Use periodically to reflect changes in our services, platform features, or legal requirements. Changes take effect once published on the website and app. Where changes are material, we will notify registered users via email or an in-platform notification. Continued use of SearchTalents following any update constitutes your acceptance of the revised Terms.
